Terms of Service

Miskech Photography, owned by Colbey Miskech, provides professional wedding, portrait, and custom photography. We serve York and Lancaster counties as our primary area, with limited service in Cumberland and Adams counties. By engaging our services, you agree to these binding terms, ensuring professionalism and clarity for both parties.

Primary Area: York and Lancaster counties (included in base pricing).

Secondary Area: Cumberland and Adams counties (flat $250 travel fee).

For locations outside these areas, written approval is required. Travel over 3 hours one-way requires client-covered lodging and meals. Travel fees must be paid with the final balance. We reserve the right to decline locations based on feasibility.

Taxation: In accordance with PA state law, all digital and physical photography services are subject to 6% Sales Tax, to be added on top of all quoted package prices.

Retainers & Balances: A 50% non-refundable retainer secures your date. Wedding balances are due 14 days prior; other sessions are due in full 24 hours prior. Late payments incur a $25 daily fee; returned checks incur a $25 fee.

Accepted Methods: Credit/Debit (Visa, MC, AmEx, Discover), Apple Pay, BNPL (Klarna/Afterpay), ACH, PayPal, and Venmo.

Weddings: Our dual-lead documentary approach is structured as:

• Essentials ($2,995+): 6 hours, single lead + assistant.
• Signature ($3,995+): 8 hours, dual-lead partnership + engagement session.
• Legacy ($4,995+): 10 hours, dual-lead partnership, engagement session, and premium album.

Portraits: Mini ($350+), Full ($550+), and Extended ($800+). All sessions are subject to 6% PA Sales Tax.

Tardiness: A 15-minute grace period exists. Beyond that, a $25 fee applies per 15-minute increment. Arrivals over 30 minutes late are considered a no-show/forfeiture of fees.

Rescheduling: One reschedule is permitted with a $50 fee if requested 72 hours prior. Further changes require a new retainer.

Conduct: We reserve the right to terminate service immediately for harassment or unsafe working conditions. No refunds are issued in such cases.

Copyright: Miskech Photography retains all copyrights. Images are for personal use. Commercial/public use requires written permission. We reserve the right to use all imagery for marketing.

RAW Files: RAW files are the proprietary work-in-progress of the artist and are never released. They may be licensed for select purposes at $250 per image, subject to contract.

Liability: Liability for equipment failure is limited to a refund of monies paid. We are not responsible for consequential damages. In cases of Force Majeure (severe weather, pandemics, illness), we will offer a credit or assistance in finding a substitute.

Galleries are delivered within 14 days of full payment. Online galleries expire after 12 months. It is the client's sole responsibility to download and backup all files within this timeframe. Miskech Photography is not responsible for data loss after gallery expiration.

Governed by Pennsylvania law. Disputes shall be resolved through mandatory mediation followed by binding arbitration in York County, PA. By booking, the client waives the right to a jury trial.
