Miskech Photography — Terms of Service

1. Introduction

Miskech Photography, owned and operated by Colbey Miskech, is a professional photography service providing wedding, portrait, and custom sessions primarily throughout York and Lancaster counties, with limited service in Cumberland and Adams counties, Pennsylvania. Services outside these areas require prior written approval and may incur additional fees.

By engaging Miskech Photography, clients agree to these Terms of Service, creating a binding contract to ensure professionalism, clarity, and mutual respect, protecting both parties from misunderstandings, liability, or disputes.

2. Service Area & Travel Fees

Primary Service Area: York and Lancaster counties — travel within these counties is included in all pricing.

Secondary Service Area: Cumberland and Adams counties — subject to a flat $250 travel fee (no additional mileage fees apply).

For locations outside York, Lancaster, Cumberland, and Adams counties, prior written approval is required. Additional mileage fees and custom pricing will apply based on distance and logistics.

For travel requiring over 3 hours one-way, clients must cover reasonable lodging, meals, and incidental expenses, confirmed in writing before booking.

All travel fees must be paid as part of the contract payment schedule. Non-payment may result in service cancellation without refund.

Miskech Photography reserves the right to decline bookings outside the primary and approved secondary service areas based on feasibility and financial viability.

3. Pricing & Payment

All pricing is subject to change without notice and is only guaranteed upon signed agreement and receipt of deposit. Pricing shared via website, email, or promotional materials are estimates unless confirmed by contract.

• Standard Sessions: $300–$700
• Weddings: $1,995–$3,200+

Add-Ons:

• Engagement Session – $500
• Second Photographer – $500
• Extra Hour – $350 per hour

A non-refundable deposit of 50% is required to secure any booking. The remaining balance must be paid in full no later than 14 days prior to wedding events and before gallery delivery for all other sessions. Failure to pay on time may result in cancellation without refund or access to deliverables.

Accepted payment methods include:

• Credit & Debit Cards (Visa, MasterCard, AmEx, Discover)
• Digital Wallets (Apple Pay)
• Buy Now, Pay Later options (Klarna, Afterpay)
• ACH Transfers (U.S. only)
• Third-Party Platforms (PayPal, Venmo)

Returned checks incur a $25 fee. Late payments incur a $25 daily fee until paid in full. Taxes and processing fees are included unless otherwise specified.

All contracts and invoices are securely issued and stored digitally via Squarespace, providing legal enforceability and records.

4. Wedding Photography

Wedding packages are customizable to client needs. Final bookings require a signed contract and deposit. Clients must provide venue information, timelines, and shot lists at least 30 days before the event. Failure to provide timely details may affect service quality and is the client’s responsibility.

• Essentials – $1,995: 6 hours, one photographer + assistant, approximately 150 edited images.
• Signature – $2,495: 8 hours, two photographers, engagement session included, approximately 250 edited images.
• Full-Day – $3,200+: Up to 10 hours, two photographers, engagement session + optional album, approximately 400+ edited images.

Travel within York and Lancaster counties is included. Travel fees for other counties apply as specified in Section 2.

5. Photography Sessions

Sessions range from 45 minutes to 2.5 hours and include a curated, digitally delivered gallery. Travel outside York and Lancaster counties requires pre-approval and applicable travel fees per Section 2.

• Mini – $300: 45-60 minutes, 25 edited images.
• Full – $500: 90 minutes, 60 edited images.
• Extended – $700+: Up to 2.5 hours, 100+ edited images, album options available.

6. Late Arrivals & Rescheduling

A 15-minute grace period is allowed for client tardiness. After 15 minutes, a $25 fee applies for every additional 15-minute increment. Arrivals later than 30 minutes without communication will be considered a no-show and all payments will be forfeited.

Clients are permitted one reschedule with a $15 fee if requested at least 72 hours prior to the original booking. Subsequent reschedules require a new contract and deposit.

7. Cancellations & Refunds

Deposits are strictly non-refundable under all circumstances. Cancelations after final payment result in full forfeiture of all fees paid. No refunds will be issued for dissatisfaction regarding style, posing, or editing preferences. Clients are urged to review Miskech Photography’s portfolio prior to booking to ensure style alignment.

8. Delivery & RAW Files

Final edited galleries are delivered digitally within 14 calendar days following the session or event, contingent on full payment. Typical editing turnaround is 3–7 business days. Rush delivery is available for an additional $150 express fee.

Raw/unprocessed (RAW) files are not included in any package and may be licensed separately for $250, subject to signed licensing and release agreements. Additional edited images beyond the package may be purchased at $17 per image.

9. Promotional Use & Copyright

All images remain the exclusive intellectual property of Miskech Photography unless a separate licensing or copyright transfer agreement is signed. By default, clients grant Miskech Photography perpetual, royalty-free rights to use images for marketing, portfolio, and promotional purposes (websites, social media, print, etc.).

Clients may opt out of promotional use by submitting a written request prior to the session or event date. Licensing or full copyright transfer is available for $250 per image, subject to written approval and contract.

10. Legal & Disputes

This agreement is governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall first attempt mediation, followed by binding arbitration conducted in York County, Pennsylvania. The non-prevailing party will bear all legal fees and costs. Clients waive the right to jury trial or court litigation for disputes related to this agreement.
