Miskech Photography — Terms of Service

1. Introduction

Miskech Photography, owned and operated by Colbey Miskech, provides wedding, portrait, and custom photography services across York, Lancaster, Cumberland, and Adams counties. Services outside of these areas may be offered on a case-by-case basis and are subject to approval. By booking with Miskech Photography, you acknowledge and agree to the terms outlined in this document, which is designed to establish clear expectations and ensure a professional, smooth, and positive experience for all clients.

2. Pricing & Payment

All session and wedding photography pricing is provided as a guideline. Exact pricing may vary based on client-specific requirements. Standard session rates begin at $300 and typically range between $500 and $700. Wedding packages range from $1,995 to $3,200+. Additional custom options, services, or add-ons are available upon request. The fees for common add-ons are listed below:

• Engagement Session: $500
• Second Photographer: $500
• Additional Hour of Coverage: $350 per hour

All bookings require a 50% non-refundable deposit to secure your date. Deposit amounts range from $150 to $1,750 based on the scope of services chosen. Full payment for wedding packages is due two weeks prior to the event date, and for all other photography sessions, the remaining balance is due the day before gallery delivery.

Payment for services can be made through the following methods, all of which are securely processed via Squarespace Payments powered by Stripe:

• Credit & Debit Cards: Visa, MasterCard, American Express, Discover, Diners Club, JCB, UnionPay
• Digital Wallets: Apple Pay
• Buy Now, Pay Later: Klarna, Afterpay (Clearpay in the UK)
• Bank Transfers: ACH Direct Debit (U.S. only)
• Third-Party Payments: PayPal, Venmo

If you wish to use a payment method not listed above, please contact us directly to discuss alternative arrangements.

A $25 fee will be applied for returned checks. Late payments will incur a $25/day late fee, at the discretion of Miskech Photography. All taxes and applicable fees will be included in your invoice, and all payments are securely processed via the aforementioned platforms.

Note: All contracts, invoices, and related documents will be created, sent, and managed through Squarespace, ensuring secure, transparent transactions and contract management.

3. Wedding Photography

Wedding photography packages are designed to offer flexibility and value while capturing the essence of your special day. The following packages are available:

• Essentials – $1,995: Includes photographer + assistant, 6 hours of coverage, ~150 edited photos, local service area only.
• Signature – $2,495: Includes two photographers, 8 hours of coverage, Engagement session, ~250 edited photos, local service area only.
• Full-Day – $3,200+: Includes two photographers, up to 10 hours of coverage, Engagement + album options, ~400+ edited photos, local service area only.
• Extras: Engagement Session – $500, Second Photographer – $500, Additional Hour – $350/hr

There is no additional travel fee within York, Lancaster, Cumberland, or Adams counties. For weddings outside of these areas, a flat $250 travel fee will be charged. Clients are required to provide venue details, event timeline, and any specific instructions at least 30 days prior to the event. Failure to provide this information in a timely manner may result in additional fees or cancellation of the service.

Wedding bookings are only confirmed with a signed agreement and deposit.

4. Photography Sessions

Photography sessions include a variety of packages designed to suit different needs, including senior portraits, family photos, and creative portraits. Sessions last between 45 minutes and 2.5 hours, depending on the selected package. Each session includes a curated gallery of edited images delivered digitally.

Sessions are available only within our service area (York, Lancaster, Cumberland, and Adams counties). Travel outside of these areas is subject to approval and will incur a flat $250 travel fee.

• Mini Session – $300: 45 minutes of coverage, 25 edited images, Online gallery, Available within service area only.
• Full Session – $500: 90 minutes of coverage, 60 edited images, Online gallery, Available within service area only.
• Extended Session – $700+: 2.5 hours of coverage, 100 edited images, Gallery + album options, Available within service area only.

5. Late Arrivals & Rescheduling

A 15-minute grace period is allowed for late arrivals. After 15 minutes, a late fee of $25 will be charged for each additional 15-minute increment. If you are more than 30 minutes late without prior contact, the session will be marked as a no-show, and no refund will be issued.

Clients are allowed one reschedule per booking for a $15 rescheduling fee, subject to availability. Any further reschedules will require a new agreement and deposit. Rescheduling must occur at least 72 hours in advance of the scheduled session.

6. Cancellations & Refunds

All deposits are non-refundable. In the event of a cancellation or no-show, the deposit will be forfeited. Refunds will not be issued for dissatisfaction with editing style or image selection. It is strongly recommended to review the photographer’s portfolio before booking to ensure alignment with your expectations.

For cancellations made after the final payment has been made, no refund will be issued, and the full balance will be forfeited.

7. Delivery & RAW Files

Images will be delivered within 2 weeks of the session or wedding date, provided full payment has been made. Editing typically takes 3–7 days, and rush delivery is available for a $150 rush fee.

RAW files may be purchased for a $250 licensing fee, subject to a licensing agreement. Additional individual image purchases are available for $17 per image, upon approval and with a formal agreement.

8. Promotional Use & Copyright

All images are copyrighted by Miskech Photography. By booking, you grant Miskech Photography the right to use the images for portfolio, marketing, and promotional purposes unless a written opt-out request is made at the time of booking. Copyright may be transferred via a licensing agreement for $250 per image, which will be formalized in a separate contract.

9. Policy Updates & Legal

These terms are subject to change, and updates will be posted on our website. Continued use of Miskech Photography’s services constitutes acceptance of the most recent terms. Any disputes arising from these terms will be governed by Pennsylvania state law, and any legal action will be resolved through mediation or arbitration, with costs to be borne by the responsible party.
