Miskech Photography — Terms of Service

1. Introduction
Miskech Photography, owned and operated by Colbey Miskech, is a professional photography service offering wedding, portrait, and custom sessions throughout York, Lancaster, Cumberland, and Adams counties in Pennsylvania. Services rendered outside these counties are subject to pre-approval and may incur additional fees. By engaging in business with Miskech Photography, you are entering into a legally binding agreement and are thereby consenting to all terms set forth herein. These terms are designed to ensure professionalism, accountability, and mutual respect in all engagements and protect both parties from miscommunication and liability.
2. Pricing & Payment
All rates are subject to change without notice and are finalized only upon signed agreement and deposit. Prices provided via website, email, or promotional materials are estimates unless confirmed through an executed contract. Base pricing is as follows:
- Standard Sessions: $300–$700
- Weddings: $1,995–$3,200+
Common Add-Ons:
- Engagement Session – $500
- Second Photographer – $500
- Extra Hour of Coverage – $350/hr
To secure a booking, a non-refundable deposit of 50% of the total cost is required. Remaining balances must be paid in full no later than 14 days prior to wedding events and prior to gallery delivery for all other sessions. Failure to pay by the deadline may result in cancellation without refund.
Accepted payment methods (via Squarespace Payments powered by Stripe):
- Credit & Debit Cards (Visa, MasterCard, AmEx, Discover, etc.)
- Digital Wallets (Apple Pay)
- Buy Now, Pay Later (Klarna, Afterpay)
- ACH Transfers (U.S. only)
- Third-Party Platforms (PayPal, Venmo)
Returned checks will incur a $25 fee. Late payments are subject to a $25 per day late fee. Taxes and applicable processing fees are included in your invoice unless otherwise specified.
All contracts and invoices are issued and stored digitally through Squarespace, ensuring legal enforceability and secure documentation.
3. Wedding Photography
Wedding packages include varying levels of coverage tailored to suit the unique needs of each couple. All bookings must be finalized with a signed contract and deposit. Venue details, event timelines, and shot preferences must be submitted at least 30 days prior to the event date. Failure to do so may impact service quality and is the client’s responsibility.
- Essentials – $1,995: 6 hours, one photographer + assistant, ~150 edited images
- Signature – $2,495: 8 hours, two photographers, engagement session, ~250 edited images
- Full-Day – $3,200+: Up to 10 hours, two photographers, engagement + optional album, ~400+ edited images
Travel within the local counties is included. A flat $250 travel fee applies to locations outside these areas unless otherwise agreed in writing.
4. Photography Sessions
Sessions include pre-planned or custom shoots ranging from 45 minutes to 2.5 hours. All sessions include a curated, digitally delivered gallery. Travel outside the service area is subject to a $250 flat fee and must be approved in advance.
- Mini – $300: 45-60 minutes, 25 edited images
- Full – $500: 90 minutes, 60 edited images
- Extended – $700+: 2.5 hours, 100+ images, album options available
5. Late Arrivals & Rescheduling
Clients are permitted a 15-minute grace period for tardiness. Beyond this, a $25 fee per 15-minute increment applies. Arrivals exceeding 30 minutes with no communication are marked as no-shows and forfeit all payments.
Each booking includes one allowable reschedule with a $15 rescheduling fee, provided it is requested 72+ hours in advance. Additional reschedules will require a new agreement and deposit.
6. Cancellations & Refunds
All deposits are non-refundable under any circumstance. If a client cancels after the final payment, the full amount is forfeited. No refunds will be issued for dissatisfaction related to style, posing, or editing preferences. Clients are strongly encouraged to review Miskech Photography’s public portfolio before booking to ensure stylistic alignment.
7. Delivery & RAW Files
Final galleries will be delivered digitally within 2 weeks of the session or event date, contingent on full payment. Editing generally takes 3–7 business days. Rush delivery is available for a $150 express fee.
Unedited (RAW) files are not included in standard packages but can be licensed for $250, subject to terms and a formal release agreement. Individual additional images may be purchased at $17 per image.
8. Promotional Use & Copyright
All images remain the exclusive copyright of Miskech Photography unless a separate licensing agreement is executed. By default, the client grants Miskech Photography perpetual, royalty-free rights to use images for marketing, portfolio, and promotional purposes, including but not limited to website, social media, and printed material. Opt-out requests must be submitted in writing prior to the session or event date. Licensing or full copyright transfers are available for $250 per image and are subject to written approval and contract.
9. Legal & Disputes
This agreement is governed by the laws of the Commonwealth of Pennsylvania. All disputes arising under or related to these terms shall be resolved first through mediation, and if necessary, binding arbitration in York County, PA. Legal fees and associated costs are the responsibility of the non-prevailing party.
Miskech Photography reserves the right to amend these Terms of Service at any time. Continued engagement constitutes acceptance of any future revisions. The most current version of the Terms of Service is always available on our website.
